Appeal dismissed at former seaside restaurant
BBCA planning enforcement appeal has been dismissed after people were seen using a former restaurant as accommodation, according to officials.
The Nude Dunes restaurant at La Pulente closed unexpectedly in November 2023.
Jersey's infrastructure and environment department said an investigation began following a site visit in June when an adult and three children were seen leaving the property carrying a laundry basket.
An independent inspectors report said the owner stated overnight stays had been undertaken for security reasons, to indicate that the site had not been abandoned.
The inspector said she was "not persuaded" beds at the site were to dress the building to potential buyers.
"I accept that those who have stayed in the building have alternative 'homes'," the report said.
"However, that does not detract from the fact that the building was being used as a residential unit at least at the time that the notice was served and that this falls outside the authorised use of the building."
A second appeal, in relation to the installation of a 7m (22ft) tall wooden fence and a modular storage pod at the site, was also rejected.
The enforcement notices would remain in place, officials said.
Initial plans to turn it into self-catered holiday accommodation were rejected in 2024 and revised plans were unanimously rejected earlier in 2025 due to concerns about the potential impact on the landscape.
It has now been reclassified as a site for commercial use, which means future purposes could include being used as a shop, offices or a medical practice.
