Egyptian club Ismaili is prepared to go to Fifa if Caf do not find in their favour in their quest to take the African Champions League title from Nigeria's Enyimba.Fifa however have told the BBC Sport website that since the case is related to a confederation championship the confederation itself is competent to take a final decision.
Caf's Inter-club committee on Saturday failed to reach a decision on Ismaili claims that Enyimba fielded two ineligible players in the African Champions League final last year.
Ismaili presented video and documentary evidence that Ahmed 'Yaro Yaro' Garba played for Nigerian side Kano Pillars at the same time he was registered for Enyimba in the African Champions League.
Garba appeared for Enyimba as a substitute in the second leg of the Champions League against Ismaili in Cairo.
The Egyptian club also claim that Ndidi Anumnu, who scored in the first leg of the final, played for and is the captain of Iwuayanwu Nationale in Nigeria.
The President of the Ismaili club Ismail Osman says that they are prepared to wait for Caf's decision but will got to Fifa if they do not get a favourable decision.
"We aren't disappointed with the failure to get a decision because we know that the matter is not over yet," he said.
"We have great respect for Caf but if we don't get the decision we are going to go to Fifa.
"We feel have all the documents that we need to prove our case.
"Caf say they want to check the authenticity of the documents, but we also have videos and they are much more difficult to fabricate."
Osman however is frustrated by Caf's failure to set a date for a final decision.
"We don't know when there will be a ruling, there is another meeting in two months time but we feel that is too late and we are pressuring to get this matter settled," he said.
Ahmed Osman a member of the board at Ismaili is equally determined to get a ruling in their favour.
"We have the Egyptian Football Association behind us and if Caf don't give us the trophy we will take the matter to Fifa," he told the BBC Sport website.
"We will submit the same evidence to them but we can't do anything more now until Caf come to some sort of decision.
"We must continue until we feel we have got justice."
