Council victory in travellers row

Traveller families have lived at Smithy Fen for 40 years
Two appeal court judges have ruled that no more caravans should be allowed to move on to a travellers' site at Cottenham.

Judges granted South Cambridgeshire District Council an injunction against "persons unknown" who might move to the Smithy Fen site.

In July, the council was refused an injunction preventing more caravans arriving by a county court judge.

The legal move followed concerns from villagers that the site is too large.

More than 1,000 villagers in Cottenham threatened to withhold their council tax if the site was not curtailed.

Planning breach

They were angered when travellers asked for 11 more pitches.

The travellers had been developing the site in the Smithy Fen area illegally before applying for planning permission.

Planning officials reported hard standing surfaces had already been laid on many of the plots.

A number of caravans were already stationed on them in breach of planning controls.

On Friday, Lord Justice Brooke and Lord Justice Clarke ruled the courts did have the power under the 1990 Town and Country Planning Act to grant an injunction.

A travellers' site has existed near Cottenham for 40 years.
