Di Equality Court for Western Cape Town bin find Malema guilty of hate speech on Wednesday, for one case wey South Africa Human Rights Commission bin file against am.
But EFF say dem go appeal di court ruling not becos dem wan protect dia commander in chief, but becos dem wan defend "political freedom, historical truth, and di right of pipo wey dey oppressed to tok wit dia full chest against dia oppression".
E describe di judgement as agenda wey wan make dis discussion on revolution illegal.
"Dis judgement seriously bend di history, philosophy, and nature of political speech for democratic society," di statement tok.
Dem add say di way wey di court take interpret some of di tins wey di revolution leader bin tok, don yeye di "political, historical, and ideological context," of im speech, plus reduce revolution to become crime.
South Africa na kontri wey dem build on political, structural and physical violence. E bin struggle against apartheid sake of white supremacy bifor di Black pipo finally get independence from dia colonisers.
Di revolution party say even though di court ignore dis history from wia dia activities from dey come, na "di irreconcilable conflicts between White supremacy and Black consciousness," na im Malema bin dey tok about wen im tok about "war".
"To criminalise dis language na to criminalise Black consciousness and silence any radical challenge of White supremacy," e add.
Dis case dey come from one 2022 rally wia Malema bin dey para for party members say dem no act against one White man wey follow one group of pipo attack dem outside Brackenfell High School, for Cape Town for October 2020.
For dat speech for Cape Town, Malema bin ask im members why dem bin no "follow up" wit di White man, catch am "for one lonely corner and attend to di guy properly".
But di judge, Mark Sher, tok for im judgement say, for Malema to single out White males sake of dia race and call for dia murder for im speech no dey acceptable.
