Nottingham Forest manager Billy Davies says striker Nathan Tyson was naive in waving a corner flag near Derby fans after the 3-2 victory on August 29.
Tyson was surrounded by Rams players and has been charged with improper conduct, while both clubs were charged with failing to control their players.
"He's far from a troublemaker, he was going to the other side of the pitch," Davies told BBC East Midlands Today.
"It was a little bit naive, there was no malice in what he was trying to do."
Forest are now mounting a vigorous defence of their part in the melee.
Davies said: "If you've got a mixed section of fans at a certain end of a ground, clarity is required as to whether you're ridiculing the away support or applauding your own fans.
"Consistency and clarity is required so we know exactly where we stand in the future."
