Hull City chairman Phil Duffen will decide with Craig Fagan whether to take legal action after the striker fractured his left leg on Saturday.

The 25-year-old was injured after a tackle by Newcastle's Danny Guthrie in Hull's 2-1 victory at St James' Park.

A Hull spokesperson told BBC Sport on Thursday that Fagan was "devastated" but a decision regarding any subsequent action was still to be finalised.

Guthrie is set to serve a three-match ban for his sending off.

Hull manager Phil Brown had said Guthrie's red card and three-game ban was insufficient punishment, but the Football Association revealed on Wednesday that it did not have the power to extend automatic suspensions.

Guthrie said he was "very upset" to learn of the injury verdict and vowed to apologise to Fagan in person.

Duffen added: "To be frank, this is the sort of incident that, had it happened in the street, would have been regarded as common assault.

"We will be sitting down with (Fagan) and discussing what to do, what decision or what action he might want to take. The timing of it for Craig and the implications, short term, for his career could be significant.

"He was in the team, playing well and you have to take into account his earning ability in terms of performance bonuses and things like that."

Fagan rejoined Hull City in a �750,000 move from Derby County in July, signing a three-year deal at the KC Stadium.
