Jockey Frankie Dettori has been fined �250 after breaching controversial mobile phone restrictions. The in-form Italian rode a 48-1 treble in the first three races of Monday's card at Bath.
But he landed in trouble with the new rules after one of those successes.
Jockey Club spokesman John Maxse said Dettori used a phone handed to him by a member of the public on his return to the weighing room.
The Club introduced strict rules on riders using mobile phones at racecourses in an effort to boost the sport's integrity.
Jockeys are furious with the new rules, and their protests have included boycotting a meeting at Sandown this month, which led to its cancellation. Maxse admitted Dettori was unfortunate to have fallen foul of the rules.
"He was handed a phone by a member of the public and he took the phone and spoke into the phone," said Maxse.
"I don't think he had any idea who the person was. I think it was just someone who interrupted his progress and handed him a phone."
He said an inquiry was held after the incident was spotted by the press, racegoers and officials.
"It was unfortunate because I don't think the restrictions have been in long enough for it to become second nature for him to turn down such a situation," said Maxse.
Paul Scallan was the first rider to be punished under the new rules. He was also fined �250 a fortnight earlier.
