BBC New Songwriters Award - Rules and Regulations 2007


1. These are the contest rules ("Rules") and apply to The BBC Radio 2 New Song Writers’ Academy (“Competition”) organised by the British Broadcasting Corporation (“the BBC”) in association with the British Academy of Composers & Songwriters (“BAC&S”), British Music House, 26 Berners Street, London, W1T 3LR. By entering this Competition, entrants (“Entrants”) agree to be bound by these Rules.

2. In consideration of the BBC agreeing to assess entries to the Events each Entrant by entering licenses the BBC for itself and those authorised by it the exclusive right to use an entry for communication to the public (which includes broadcasting and internet use) and all other rights for the purposes of the Competition only. This licence shall subsist until the Entrant is unsuccessful, or in the case of successful entries until the end of the Competition (30/04/08) or until the Entrant is notified that they have been unsuccessful if sooner or if later until the conclusion of any good faith continuing discussions with the BBC concerning future use of the entry.

3. Entrants consent to being filmed and recorded by the BBC where required for the Competition and for films or recordings made pursuant to this rule being used for all purposes of the Competition.

4. Entrants agree to grant the BBC and BAC&S and its partners a non-exclusive licence to broadcast their entry across all media including any online platforms under their control. This licence does not affect Entrants moral rights and Entrants will retain full rights in their recording and composition insofar as they are the original author.

5. In respect of BBC Airplay the licence will be operated in accordance with the BBC’s licence with the Performing Right Society (“PRS”). Should Entrants wish to reclaim any royalties that may be generated by performances of their material they will need to apply to PRS for membership and be accepted in accordance with their terms and conditions. All other online broadcasts/performances will be governed by the MCPS-PRS Alliance joint online licence scheme.

6. Entrants permit the BBC to edit or change entries in any way it may in its sole discretion consider necessary for the purposes of use in the Competition and the broadcasting thereof.

7. All submissions must be completely original; no samples or work of other artists can be used. The Competition organisers accept no liability if Entrants ignore this rule and Entrants agree to indemnify fully the BBC and BAC&S against any claims by any third party arising from any breach of this or any other rule.

8. The Entrant(s) must be the sole author(s) of the entry (except where more specifically provided).

9. Entries must not contain defamatory or obscene material.

10. Additional evidence may be required in order to verify an Entrant’s identity. This may include a valid passport or driving licence. By entering the Competition, Entrants hereby warrant that all information submitted by them is true, current and complete.

11. By using the site and/or entering the Competition, Entrants warrant that they have legal capacity to enter the Competition and agree to be bound by the Rules (i.e. that they are of sufficient age and mental capacity and intend to be bound by these Rules).

12. The BBC reserves the right to refuse any entry for any reason at its absolute discretion and to disqualify any Entrant if it has reasonable grounds to believe the Entrant has breached any of these terms and conditions.

In the event that any Entrant is disqualified from the Competition, the BBC may decide whether a replacement contestant should be selected. In this event, further Entrants will be selected on the same criteria as the original Entrant and will be subject to these Rules. The BBC reserves the right to vary the terms of the competition or cancel it if it deems it necessary to do so or if circumstances arise outside its control.

13. Only one entry per person or group is allowed. Competition entries must be made in the manner and by the closing date specified on the Competition Notice. Failure to do so will disqualify the entry.

14. It is a requirement of this Competition that Entrants must be 19 years or over by Monday 3rd December 2007.

15. Entries are made at an Entrant’s own expense and risk and the BBC shall not be liable to reimburse any expenses incurred in making an entry.

16. Entry to the Competition may be via the Competition website or by postal entry. Entrants should note that the BBC does not accept responsibility for, and cannot return any Competition entries, including those consisting of artistic or other material. It is therefore advisable for each Entrant to retain a copy where appropriate. Proof of posting or uploading cannot be accepted as proof of delivery.

17. Attendance by Entrants at any event staged by the BBC (including but not limited to master classes and mentor sessions, attendance at which may be won as a prize) (“Event(s)”) and travel to and from any such Event is also at the Entrant’s own risk and the BBC accepts no responsibility or liability in this regard. Reasonable travel expenses for successful Entrants invited to Events will be paid by the BBC.

18. All Entrants must (except where otherwise provided) be resident in the United Kingdom. For those Events which offer successful candidates freelance work or employment contracts Entrants must be eligible to work in the United Kingdom.

19. People who work for BBC Radio 2 or BBC New Talent and employees of BAC&S or any other company or individual involved in the running of the Competition are not eligible to enter the Competition. The BBC reserves the right to verify the eligibility of all Entrants.

20. The decisions of the judges are final. Neither correspondence nor discussion concerning any decision shall be entered into. Unless specifically stated unsuccessful Entrants in any stage may not be contacted by the BBC due to the large number of entries anticipated. The BBC shall not be obliged to make use of any entry and shall not be liable for any loss of publicity or enhancement of reputation.

21. Successful Entrants will be notified in the manner and within the time specified on the Competition website. Return of any prize notification as undeliverable or failure to reply as specified in the notification within the time stated therein may result in disqualification and selection of an alternate winner. Eligibility for selection for the prize of a mentor recording session is conditional upon being selected for, and attending a master class.

22. The BBC and BAC&S cannot accept any responsibility for any damage, loss, injury or disappointment suffered by any Entrant entering the Competition or as a result of accepting any prize.

23. Successful Entrants may be requested to take part in promotional activities. The BBC and BAC&S reserve the right to use the names of winning Entrants, their photographs and audio and/or visual recordings of them in any publicity.

24. Any personal data relating to Entrants will be used solely in accordance with current UK data protection legislation by the Competition partners and will not be disclosed to a third party without the individual’s prior consent.

25. Entrants selected for the subsequent stages of the Competition may be asked to undertake not to accept any engagements of the kind being assessed by such Competition for any United Kingdom broadcaster other than the BBC prior to the end of the Competition without having first entered into good faith discussions with the BBC.

26. The description of the awards prizes and selection process in the Competition literature or other medium is not binding and may be varied by the BBC and the BBC may make additional awards or prizes but it shall not be obliged to make any award or prize if it considers it inappropriate to do so. Awards and Prizes are non-transferable and there is no cash alternative.

27. In the event that the BBC wishes to use an Entrant’s contributions outside the context of the Competition, and such Entrant’s contributions be broadcast or otherwise used by the BBC, the Entrant will be offered the BBC’s standard contract and terms appropriate to such contribution concerning the terms of such use.

28. Acceptance of these rules is a condition of entry and receipt of an entry by the BBC amounts to acceptance of the rules.
