Lawyers consulted over MRSA baby
Luke Day
Luke Day had the superbug MRSA when he died in Ipswich Hospital
The family of a day-old baby who died in hospital after contracting the superbug MRSA said they were not happy with a new report into his death.

A panel which investigated the death of Luke Day for Ipswich Hospital, where he died in February, said there were possible causes other than MRSA.

His grandmother, Julie Fenton, said the family was not happy with the conclusions of the panel.

She said they were consulting lawyers over possible legal action.

Health authority officials said a death certificate issued shortly after 36-hour-old Luke died identified MRSA as the cause of death - the baby was thought to be the youngest hospital victim of the bug.

It seems to be a very convenient conclusion for the hospital

But health experts commissioned by the hospital to investigate said on Monday that there were other possible causes.

They said the baby had MRSA but the cause of his death could have been lung or brain damage or sudden infant death syndrome.

Mrs Fenton said the family did not think the outcome of the inquiry was satisfactory.

"It seems to be a very convenient conclusion for the hospital. We are now consulting lawyers with a view to taking legal action," she said.

She said the fact remained that Luke had MRSA.

Parents' split

"How did he get it? And when we ask 'what was his death down to?', all they say is 'I don't know, I don't know'," Mrs Fenton said.

Following the inquiry, the hospital accepted there were deficiencies in aspects of the care given to Luke and accepted that clinical signs were missed or misinterpreted.

Luke's parents, Kevin Fenton, who is in his mid-20s, and Glynis Day, who is in her late teens, of Woodbridge, Suffolk, have split up since Luke's death.

Mrs Fenton said Miss Day was pregnant by another man.
