Michael Jackson was treated for flu-like symptoms

Lawyers for the family of Manuela Gomez Ruiz now have 30 days to redraft their complaint, which Jackson's legal team said was not justified by the facts.

The 73-year-old's family claimed she was denied critical care at the Marian Medical Centre, California, in 2005.

Jackson was admitted for treatment during his child molestation trial.

The musician was suffering from flu-like symptoms during the court case. He was later cleared of all charges.

'Circus-like atmosphere'

The family of Ms Ruiz are suing both Mr Jackson and the medical centre.

They said in court documents that Ms Ruiz was in a room with two beds on a life support machine after suffering a heart attack when she was moved to accommodate the pop star.

After she had been moved, Ms Ruiz was kept alive in an examination room using hand-pumped oxygen until she could be reconnected to vital machinery, the claim continued.

She suffered a further heart attack and her arrival at the intensive care unit was delayed by crowds waiting to catch a glimpse of Jackson, stated the complaint.

Ms Ruiz died later that night.

The legal papers also detailed the "outrageous, circus-like atmosphere they orchestrated during the last hours of Manuela Ruiz's life and its obvious emotional and mental lasting effects upon the plaintiffs."
