The actress will still have to complete 30 days of community service, said a spokesperson for the Los Angeles attorney's office.

Rodriguez was sentenced for breaking a probation order when she was arrested for drink-driving in Hawaii last year.

She spent 65 hours behind bars for that offence in April.

Her probation has now been extended until 2009.

She must also attend an educational course on the effects of alcohol, the Mothers Against Drunk Driving victim impact panel and the city's hospital and morgue programme.
