Singer Rod Stewart is being sued for breach of contract after it was claimed he took more than �1m for a cancelled concert in 2000. Stewart faces a civil trial in Las Vegas after gambling and entertainment company Harrah's launched the legal action against the star.
The 60-year-old singer said he cancelled the show because he was recovering from thyroid cancer surgery.
He added he retained his pre-paid fee to perform at a later date.
Court order
Stewart's lawyer Skip Miller said the singer is willing to perform the concert now but is not being allowed to do so.
The singer and Harrah's chairman Gary Loveman are both expected to be called as witnesses at the trial.
In November, Stewart was ordered by a Los Angeles court to repay an Oklahoma company after a Latin America tour was cancelled in 2002.
Mr Miller said Stewart is appealing against the decision and had no relevance to the Las Vegas trial.
