Jones has made a disappointing start to the 2005 season

A judge ruled the Sydney Olympic gold medallist's case could damage Conte ahead of his criminal trial where he is accused of distributing steroids.

Conte told a US TV show he supplied Jones with performance-enhancing drugs, and she is now seeking compensation.

Jones' lawyer Rich Nichols said: "We respect the judge's decision and will look forward to our day in court."

He added: "Marion Jones will prove that Victor Conte made 'false, malicious and misleading' statements."

Jones has never failed a drugs test and has continually denied ever taking banned substances.

The American sprinter, who came away from the Athens Olympics empty handed, is under investigation for steroid use by the US Anti-Doping Agency as part of their inquiry into the Balco scandal.

The company is alleged to have been at the centre of a steroid distribution ring supplying sportsmen and women in the US and overseas.

Conte along with James Valente, coach Remy Korchemny and trainer Greg Anderson will stand federal trial in September 2005. All three deny the charges.
