Sri Lankan military forces did not shoot at anybody who wanted to surrender during the war, the Colombo High Court was told on Monday.

The commander of the 58th Division, Major General Shavendra Silva giving evidence in a trial against the former army commander said that a lot of people surrendered to the military during the last phase of the operation.

According to him, some were carrying white flags and some did not, but all were given food, medicine and shelter.

The 58th division, which is credited with a series of military successes against the rebels, battled hard to forge ahead from Mannar up to Pudumatalan beach on the eastern coast in Mullaitivu district.

Major General Shavendra Silva told the court that clear instructions were given by the defence secretary to the security forces not to shoot any defector or surrendering people.

Public disaffection

Imprisoned former army commander Sarath Fonseka, is accused of spreading public disaffection by quoting allegations that the defence secretary Gotabaya Rajapaksa ordered surrendering Tamil Tiger leaders to be shot dead last year.

Secretary Rajapaksa denied the allegation that he ordered to shot surrendering tiger leaders.

If found guilty of inciting people to violence, Former Army Commander Fonseka could end up with another jail sentence that may extend his time behind the bars up to 20 years.
