Appeal Court rejects SB's petition
Former UNP miniser S.B.Dissanayake

Appeal Court on Thursday rejected a petition filed by United National Party (UNP) MP, S.B.Dissanayake seeking an order not to unseat him and appoint another in his place.

The former UNP Minister, Dissanayake is currently undergoing a two year imprisonment. He was jailed for contempt of court.

The two member bench comprising K.Sripavan and Ranjith Silva announcing the judgement said they rejected issuing notice to hear the petition filed by Dissanayake.

Defence lawyer, K.N.Choksy challenged that 'contempt of court' is not an offence to be punished under the penal code. Therefore, he said that there is no provision to unseat the MP.

Deputy Solicitor General Palitha Fernando arguing said it is illegal to challenge a Supreme Court decision and therefore appeal court is powerless to hear the petition.
