From Tuesday 2 January smoking will be banned from all enclosed work places in Jersey.

At 04:00 on Tuesday 2 January 2007 the island will be adopting an island wide smoking ban in all enclosed work places.

The States of Jersey voted on the proposition during a sitting on Tuesday 21 November 2006. At the end of a relatively short debate, the overall proposition, banning smoking in workplaces, was voted for with 38 votes to three.

The three States members voting against the proposition included the Constable of St Martin as well as Deputy’s Baudains and Ferguson.

The proposition to ban smoking in enclosed places in the island has been around for about 5 years in one form or another and has been put forward in the house more than once.

From 2 January you will no longer be able to smoke in pubs, clubs, restaurants, cafés, shops, offices or any enclosed place of work.

There have been a few exemptions included in the law. These include things like police cells, private work places and hotel rooms.

Senator Stuart Syvret said at the end of the debate: "It's going to be, I think, a very important public health measure. It's going to be looked back upon as a major step forward in delivering better health and longer life for the community."

The penalty for not observing the new law is up to £5000.

Earlier this year the States voted to shelve plans for a partial ban on smoking where food is served in favour of a full ban on smoking in public places.

In the original smoking ban debate, as well as agreeing to a ban on smoking where food is served, the States of Jersey also agreed in principle to a ban on smoking in all enclosed working places.

Senator Syvret said: “I have decided not to press the introduction of a ban on smoking in eating places in favour of pressing for an earlier ban on smoking in all enclosed working places.”

Around the British Isles

Scotland was the first part of British Isles to introduce a smoking ban. Their ban came into force in March 2006.

Guernsey joined Scotland in introducing their smoking ban in July and Northern Ireland will be the next area to introduce a full ban in April 2007. They will be followed by England and Wales, also in 2007.

In the second half of 2003 the States approved in principle plans to increase the age for buying cigarettes to 18, ban smoking in public eating places, ban tobacco advertising and in principle ban smoking in all enclosed working places.

The islands health authorities believe that around 200 islanders die each year from smoking-related illness. They believe the new measures will reduce the harm tobacco does to individual smokers and society generally.

At the beginning of March 2005 43% of you believed there should be a ban in all public places and not just eating places.

Since then we've had a poll running on this page asking what level of a ban you would like to see.

So far 270 of you have voted and just 4% wouldn't like to see a ban at all. The rest are split almost 50/50 between a full ban in public places and just where food is served.

We want to know what you think about the smoking ban and the fact that it comes in on 2 January 2007.

What sort of advertising should the States of Jersey do to let people know the new law is coming? Will it encourage you to give up or will you just go outside or stay at home?

Will you be more likely to go out now that there will be no smoking in island venues?

In my opinion, the ban of smoking is from something that impossible to do in ten or twenty years.

As a non smoker surely I should not have to sit in an enclosed space and breath in other peoples smoke, you sit and light up then leave it smouldering its cancer ridden fumes in a ash tray not caring what direction they go, for us non smokers to breath in. If you must smoke why not seal yourselves with your toxic fumes.

After sitting and watching a little girl under the age of 3 die of cancer the pain she had to endure I can not see why any body that has any sense would wish to put any one through that , so when you are sat in your kitchen or front room watching TV with your family why not think.... sat by a hospital bed with the person you love riddled in agony not able to talk as the pain killers are so strong they send you loopy you want the pain to go but scared of dying, thats what the very same loved ones could very well be watching but it wont be on the tv.

I know not all cancer is caused by smoking but why add to the list and put your family through such an ordeal. If you want to do it to your selves thats fine just put your selves in a cacoon and keep it to your selves.

its prooven that in other areas where they have enforced a non smoking ban that yes there will be a drop in buisness at first but it will pick up once people get used to it, they stopped people smoking in super markets but the smokers keep on shopping, got to remember that you go to the cafe for food, and i thought you went to the pub to socialise and drink, does not have to be alchol, and have a good time, if all you smokers decide that, oh well if we cant smoke in the pub then im not going anymore then its your loss, when i go to the pub i dont pull out a bag of glue and start sniffing it and then throw it all over people, or take a can of fart spray and spraying it all round the pub shouting its freedom of choice, by the way im not a glue sniffer, there has got to be a line and you got to know where to draw it, personally i think they got it spot on, why not stop smoking and money you save will go towards the next tax increase, its comming no matter what so at least you will not be as skint.

get real people, its not just the cancer risk that us non smokers are against, going home after been in a pub full of smoke, your eyes streaming, the stench of your clothes, the choking when someone sat near you has not got the common decency to hold there fag away from you so the smoke does not drift straight into your face, then you smokers go on about cars and carbon monoxide and that us non smoking drivers never complain about that, well i would complain if i were sat in that same pub or resteraut or work place and they hooked up several cars with hose pipes and pumped in the fumes so it was just as smokey as when you smokers are there, how hypocritical also to mention about us "driving non smokers" driving passed kids and letting them breath in the fumes, well how often do you smoke in front of your kids, your friends kids, even pregnant women, the difference is when your driving there is a endless supply of clean air moving arond, when was the last time you went home smelling of carbon monoxide from walking around town, i think er never, so ther is a slight defference between smoking in a enclosed area and driving in an open area, also you non driving smokers, i bet you use the busses , trains, taxis, planes, motorbikes, lets have the choice to be able to breath in clean air, stop smoking, do you want your kids to watch you die of cancer,or do you want to watch your kids die of cancer. its here at last cant wait to go to the pub and a cafe where im not eating mouth full of food and smoke. yipeee.

smoking is bad.Perhaps the most staggering statistic is that while 6 million people died during the 5 year Jewish Holocaust over 15 million people died worldwide from the effects of smoking over the same time period.The five biggest tobacco companies in the world make about 4,269,000,000,000 cigarettes every year. If you laid all these cigarettes end to end they would stretch from the Earth to the Sun and back more than 20 times. That is a lot of cigarettes! theres some info for you. lolbob

there will be a lot more fighting in public cos in the summer loads will b smoking and drinking in there own gardens....bar stafff wen applying for job knew there would b cig smoke, i leave a carbon footprint right but i av no car so will people get rid of cars for me and my family, why should we breath car polution, it all a con on goverment getting more cash.england is now a country that is scared of being ridiculed in public for wot they believe, all things considered should go to public vote yet the goverment will thank me for tax i pay on cigs lmao..if all stop smoking where will tax come from haa..plus polish etc come here taking jobs that no one wants lol, some people av no skills so do dirty or hard labour to get good pay but wen polish etc do it for min wage then it forces the wages down..why as everyone failed to see this?

I realise that smoking is the smoker's choice, and that you feel it isn't fair to be told what to do. But when your life-choice is costing the NHS money that other people need so much and harming those around you, it's a selfish choice. I'm 14 and I have already decided never to smoke, and I tell off my friends who do.

i want to see wots going to happen in the summer when all the none smokers want to sit outside the the pubs where the smokers have been kicked... are we in our right to tell them to go back inside if they dont like it??? i just see it as another govorment plot to show they can do anything they want yet again...

Im a smoker and i agree with the ban. Yeh its going to be annoying at first going outside for a fag but lets be honest its for the best. Stepping outside to smoke wont be much of a problem if you go to the pub because youll be able to stand outside the door. Pubs will probably have to accommodate for this (as they have in Guernsey which has resulted in a lot of parking being given up to make way for outside smoking areas.) Problems arise when you want to smoke in clubs like Platinum where you cant just step outside. Every time i leave there i reek of smoke which is unpleasant, however it masks the smell of sweat. I hate to think what it'll smell like in there from now on...then again i might be wrong. I hope they dont go too far in my opinion and try and ban smoking outdoors. James you're going to accept the fact that everyone will be smoking outside and therefore a ban in Al Fresco areas would really be a joke; where do you expect us all to go? Home?

Excellent, so looking forward to smoke free environment. Bars/clubs will get more of my business now. Sure smokers are going to stay away at first, but in a couple of years we will wonder why on earth we put up with it for so long. Perhaps, they could work on also a ban on smoking in alfresco areas in a couple of years. Nothing worse when enjoying meal in the sun and someone lights up and the smoke drifts.

There will no longer be ANY FREEDOM OF CHOICE. A none smoker had the choice of where to go, where to sit,which establishment to go into, which to stay away from. A smoker was more likely to be stuck in a dark corner away from polite society. What is wrong with keeping certain public places where we can enjoy a cigarette, none smokers can go to no smoking bars and public places and smokers can go to those that still allow a person to choose. Workers also have a choice, choose if you want to work in a smokey pub, a cafe where smoking is allowed, you have that right! I would NOT go in a cafe where smoking was not allowed, a non smoker had the same choice...go to one that does not allow smoking! NOW you have ALL the CHOICES and WE THE THIRD CLASS CITIZENS(smokers) have NONE! I hate the smell of any alcohol so I don't go into pubs! I hate the smell of strong perfume so I never sit beside anyone wearing it! That is my choice. Alcohol related illness and Alcohol related crime cost the tax payer a fortune...So when will Drinking be banned!

Sensitive Smell
For sufferers of conditions like Aspergers Syndrome this is definitely a blessing. Having hypersensitivity in areas like smell only amplifies the already discusting smell of cigarettes. But also asthmatics, people with lung problems and everyone else effected negatively by smoking; I am sure are all pleased by this development in the law.

The majority of the States of Jersey must be non smokers otherwise they wouldn't be banning smoking. I mean, what would be in it for them. They don't have to pay for parking or cigarettes!!!!! But I do agree with the no smoking ban

i went to my dr today and told hime i wanted to quit on 2 jan, he said great, i will give you the prescription that you need as a you should start treatment 7 days before you pack up. my horror at being told that it would cost me nearly £60 for my presciption as the discount does not take into effect until after 2 jan, talk about take with one hand and take with the other, where is the incentive to give up when they do not give you the opportunity to do so before, typical taurus extreca from the states

I have smoked since i was about 14and i gave up for 4 years when i was about 30. I am now 38. Every time that I had a cigarette after that i was so P!""%d off with myself for being so weak. I have given up smoking again and it's just coming up to one year. I am even more determined now not to smoke ever again. I never like the smell on my clothes, i never liked the taste in my mouth either. One of the things I don't like is the smell on other people. The people that do smoke probably like to have a shower or bath ever day and smell nice and clean, but if you smoke you might as well not have had a shower or bath. I'm so glad that there will be a smoking ban next year. It is one of the scummiest(if scummiest is a word) habits someone can have. My girlfriend used to smoke in the kitchen, and i was forever having to clean the kitchen as the window was always brown and the fittings in the kitchen were filthy, the ceiling was even worse. She doesn't smoke in the house now. She smokes less now. People moan what are they going to do if they can't have a cigarette. But what did they do before they smoked!!!!

If every time a Herion addict injected, you received a tiny portion of Herion into your veins, and if you worked in the same room as that addict and over several years you accumulated enough herion to develope lung caner, tumours, alveolar and lymph-gland cancers, bronchitis, tongue cancer and emphysema, would you as a smoker be happy with that? That fact that there is even a debate about the smoking ban, destroys my faith in human compassion. Are we really that selfish that in order to help save a barmaid, singer, musician, or waitress from becomming sick or dying we cant move our fat, lazy, cigarette butts to smoke outside. Is there another planet I can live on?

as a smoker i am divided over the ban yes it may help people to give up smoking but on the other hand how many people will lose jobs manufacturers, bar staff when pubs go quiet and lose business, vending companies. and when all these smokers give up WOT WILL THEY TAX TO RECOUP IN ALL THE LOST REVENUE FROM CIGERETTES AND TOBACCO

i am only 12 years old but i am doin a debate on how smoking should be banned in work places and i am against them banning them i though befor i started the debate that it should be banned but now i have actually looked into it i think that it should definatly not be banned because if it was inside in public where people smoke it wouldn’t pollute the outside air

Smoke free restaurants and bars etc. are obviously a good thing, but it's a shame that the States dragged their heels so long implementing this law and now have done so in such a poorly thought through fashion. It’s another example of a missed opportunity to have ground-breaking and advanced laws and instead adopting a facsimile of the UK or EU ideas. I want the States to be more than a cut and paste administration. What’s the point of government by plagiarism?

Its just a shame that people dont kick up such a fuss about all the winos walking around, uranating & sleeping on park benches all day & night especially around the parade area. What a good example that is to all those young children that use the swing park near by, and how much are they costing the taxpayers.

I now live in canada where smoking has been banned in all pubs & restaurants ect, and they are all busy the air is clean , it has been excepted by smokers that they smoke outside no fun when its 20below freezing , so you softies in jersey will soon get used to it .. I am a smoker also ,,

I think that the ban is disgusting! Where has free choice gone? Smokers should be able to smoke, non-smokers don't have to sit next to them! It is the pinnacle of a "nanny state" gone into overdrive, George Orwell's 1984 is now only around the corner!

Smoking has been banned in several countries for quiet a few years now and the Restaurants and Bars/Pubs are still full and making money, people need to eat and drink. As I none smoker I can now enjoy going out clean smoke free environment.

Smokers might stop going out but you will get a lot more non-smokers going out to make up for it.

People like me who can't go out at the moment because the smoke makes it difficult to breath (because of asthma or something similar).

The ban will have a massive knock on effect on pub business. Smokers just won't bother going to pubs anymore and drink at home. The added tax on drink is killing business anyhow.

I for one am not happy about the smoking ban, obviously being a smoker! but i do sympathise with the non-smoking amongst us having to put up with the smell etc BUT to ban it completely in public places is utterly ridiculas and i am afraid that i for one and most of the people i know that do smoke shall be staying at home rather than going out and being dictated to about what we can and can't do when supposedly being out and enjoying yourself!!! dont know jhow long anyone else will last but i for one will not give in, and they do say that staying in is the new going out!

A lot of places have found that the smoking ban has actually increased sales and revenue as people can now eat & drink as a family and not be concerned about children having to breath second hand smoke or themselves.

The term "British Isles" isn't a political term, it's a geographical one referring only to a group of islands off Europe. Anyway, not to give a geography lesson, perhaps you mean the United Kingdom or Britain, which of course, we are not part of. Now I just sound like a smart ass and this has nothing to do with the fabulous new vote on banning smoking in working places!

BB, I didn't think the Republic of Ireland was classes as part of the British Isles. Obviously you're very much correct, Ireland was the first country in the area to take the plunge but for this article I've written about places that are politically part of the British Isles.

I can't see why the ban on smoking would make people stay at home. After all, non-smokers have put up with the smoking environment for years. Now the tables have turned they are just going to have to accept it. Back home in Ireland (which, by the way Ryan, was the first part of the British Isles to ban it, not Scotland) so many people have now given up because of the ban. It's brilliant, and you can go for a few drinks without coming home smelling like an ashtray.

It's great news for the whole community in general; Even though I have always personally pushed for a smoking ban in cafes and restaurants, now that the total ban is almost here I feel a bit sorry for the smokers.

The community will eventually benefit as a whole, families will feel at ease going to cafes and restaurants without having to worry about smoke.

But as far as how many people will give uo smoking from the 2nd of January, well, I have my doubts.

Roll on 2nd of January 2007. The only shame is that the States members have not had the guts to show strengh, leadership and unanimity to the rest of the country and introduce the ban sooner but as always we have to follow rather than to lead. Merry Christmas and a happy 2007 to all of Jersey.

Finally The States have made one good decision! We will no longer be forced to be surrounded by cigarette smoke whenever we want to go out (or should I say: in)
