The Smoking Ban

Jersey is set to follow the rest of Britain in introducing a smoking ban in enclosed places by the end of 2006. What do you think?

Smoking on Stage

The States are set to debate whether actors will be allowed to smoke on stage during a performance if it's essential to the production.

The exception to the law will allow actors to smoke on stage as part of the performance but not during rehearsals.

It will also allow smoking in a place where a television of film recording is being made, if the production requires it.

Alfresco Eating

The St. Helier Roads Committee have put forward an idea to stop people smoking in alfresco eating areas.

Geraint Jennings of the committee has said that it makes sense for outdoor eating areas to follow the same rules as those inside.

However, one caller to the BBC Radio Jersey phone-in pointed out that stopping people smoking while eating wouldn’t make any difference.

Their argument was that you can’t stop people smoking while walking past the alfresco area and smoke has a nasty habit of travelling.

The Ban

Earlier this year the States voted to shelve plans for a partial ban on smoking where food is served in favour of a full ban on smoking in public places.

In the original smoking ban debate, as well as agreeing to a ban on smoking where food is served, the States of Jersey also agreed in principle to a ban on smoking in all enclosed working places.

Senator Syvret said: “I have decided not to press the introduction of a ban on smoking in eating places in favour of pressing for an earlier ban on smoking in all enclosed working places.”

Working with industry

He said in his statement that this decision had come about after discussions with the Hospitality Association and the hospitality industry where it was suggested the introduction of a partial ban now followed by a full ban 18 months later would be wasteful.

Senator Syvret said: “The Hospitality Association and a number of individual proprietors have argued that to proceed in this way was overly complex and potentially wasteful as some premises would be required to undertake conversion works to isolate smoking areas from eating areas with such works becoming redundant upon the introduction of the total ban on smoking in all enclosed working places.”

The Minister stressed that he felt it important that the introduction of a full ban should happen as early as possible and suggested that “It is my hope that it may be possible to have the relevant legislation in place and in effect by the end of this year.”

Senator Syvret also suggested that the change in policy was influenced by the “decision of the House of Commons by a majority of 200 to introduce a complete ban rather than confining the effects of the law to premises where food is served”.

Around the British Isles

Scotland was the first part of British Isles to introduce a smoking ban, it came into force in March 2006.

Guernsey joined Scotland in introducing their smoking ban in July and Northern Ireland will be the next are to introduce a full ban in April 2007, followed by England and Wales, also in 2007.

In the second half of 2003 the States approved in principle plans to increase the age for buying cigarettes to 18, ban smoking in public eating places, ban tobacco advertising and in principle ban smoking in all enclosed working places.

The age increase has now come into force and Senator Syvret hopes to have a full ban on smoking in enclosed working places in force by the end of this year.

The islands health authorities believe that around 200 islanders die each year from smoking-related illness. They believe the new measures will reduce the harm tobacco does to individual smokers and society generally.

At the beginning of March 2005 43% of you believed there should be a ban in all public places and not just eating places.

So far 270 of you have voted and just 4% wouldn't like to see a ban at all. The rest are split almost 50/50 between a full ban in public places and just where food is served.

Noel from the Blue Note bar in St. Helier mentioned on the BBC Radio Jersey phone-in on Wednesday 22 February that he would happily ban smoking in his venue if there was a level playing field and every venue did the same.

all you anti smokers you make me laugh i smoke my best mate dosnt but she isnt anti smokeing when will you anti smokers see that all this banning is a money makeing scheme if we all stoped smoking and driving this country would come to a hault they should do non smoking pubs and clubs resterants and so on whats next then banning anyone in your car apart from the driver why make the bloody fags then if they didnt we couldnt buy them!(oh yeh i forgot we smokers who pay the highest tax help make this country go round)so of course they cant do a complete ban or you anti smokers will be hit very hard in the pocket!!!!!!!!!!

I agree with a partial ban, there should be smoking & no smoking areas then everybody has a choice. As for a street ban, Car fumes & industrial fumes do much more harm than cigarette smoke. I don’t drive so why should I breathe in drivers car fumes while outside? A total ban is unfair & breaches my human rights. Should we ban everything that can be detrimental to our health? I don’t think so. I should have the right to smoke outside as the smoke disappears into the atmosphere. Pubs, Clubs & restaurants should have separate areas then no one is forced to smoke or not to smoke. I plan to immigrate back to Australia where I was born as this Country goes further downhill ever year. Before long we will be paying Oxygen tax & street tolls. It is becoming more & more of a Country for the Rich & privileged. As for smokers being Junkies, if that's the case then all coffee, tea & alcohol drinkers are drug users. Passive smoking is just an excuse for the government to take away another human right.

Smoking in public is totally ridiculous. Although people have a right to smoke, people also have the right to breathe in clean air. The smoker's right cancels out the vast majority of people's right to breathe; thus, smoking in public should be banned. I (nor do you) do not deserve to die just because some idiot likes to smoke filth into his/her lungs. Use common sense, people: Smoking is dangerous! Not just to the smoker, but to the innocent bystanders. For every 8 smokers the tobacco industry kills, 1 non-smoker goes with them. That's horrible! Something needs to be done--immediately.

we dont stop people drinking and getting lashed, the drinkers are more harmful to us then smoking, people who drink to much in public places 9 times out of ten get violent and abusive, smokers dont, so why should we stop smoking but allow people to drink excesivly in public places, to make it fair then put a drink limmit in every pub, club, restuarant per-person!

It is another erosion of our hard won and deeply important liberal democracy ; the salami effect. The government are prepared to use our money to employ enforcment officers, when pensioners receive terribly little money, and single parents are forced to put their tiny children and babies into day care in order to have anything like enough money to live on.This is not to mention the replusive waste of our resources destroying the lives of vast numbers of families in Irac. Okay, so the smoking ban is in place. I do smoke but not in restauarants and in that scenario I can see why the implications of smoking have lead to a ban. But nightclubs? Surely we are taking this a step too far. I can see this becoming more than its worth and what happens to those who dont comply? Do we lock them up in a cell for the night because they had a cigarette? I see fire alarms ringing because someone didnt want to go outside! "Drink and be merry, but smoke and your a social outcast" - how sad.

Smokers smoke and the residue of their habit is first and second hand smoke which people inevitably inhale against their wishes. Drinkers drink and the residue of their habit is urine. People don't allow drinkers to urinate on them against their wishes so why should they have to inhale smokers smoke against their wishes?

People who smoke are drug addicts. Pure and simple. Nicotine is highly addictive and the other chemicals in cigarettes are highly toxic. If smokers want to smoke in public places where other people are eating and drinking, then would they want addicts smoking crack, or heroin addicts shooting up around them and their kids whilst they eat and drink? Probably not. Smoking is an evil habit, most smokers don't even realise they are junkies. Plus worst of all, cigarettes are a socially acceptable drug whose tax money goes into the States' coffers. Get real. The ban is for everyone's benefit, even the smokers themselves.

It's about time that smoking is banned from all public areas. there is nothing worse than having to endure that horrible smell, whils knowing that the person emitting it is silently killing you and everyone in the surrounding area. Let's put some figures on this then, Currently the states bring in £12million in duty on tobbaco (ref 2006 Budget), guess what, stop every one smoking and suddenly there is a 12m gaping hole that will need to be filled. Shall we try and guess where it will come from? 1) More duty on Alcohol? 2) Higher Rate of GST? 3) Higher Taxes? 4) More Duty on Road Fuel? = Higher Taxi / Bus prices 5) Higher Parking Charges? i do hate smoking, i think it is an absolutely horrible addiction and i am glad that it is being banned, if you want to smoke then smoke at home but dont subject other people to your nasty habits. smoking is such an ugly site with butts all over the floor and people standing about just smoking, its horrible and it makes our country look uncivilised and sloppy.

I'd rather smokers smoked in their own shops or pubs that allowed smoking. I own an internet cafe and have to constantly ask smokers to not smoke outside the shop when the door is open as their smoke comes inside.

Il just smoke outside the pub. how hard is that?As for a ban on smoking outside, as a smoker, I'd also like to see a ban on other public nuisances, exhaust fumes, buskers out side my house all day, children who cry, ugly people, charity workers with clipboards, people who smell, over weight people shovelling food into themselves in restraunts, Morris Dancers, chavs (teenage or otherwise), lager louts, and Tories. I would suggest there are probably more important things to worry about to be honest.

This is what I think to the ban-I smoke Hubby of 32 years never has. I like a nice cup of coffee with a ciggie, Then later with Bacardi and coke, But after Autumn leaves, I will NOT – stand outside and Freeze, For an evening to relax without a smoke. I know I’m not alone in my thinking, The difference, may be my choice of drinks, But one thing is for sure, I know their are many more, Even tolerant non-smokers, think this ban just stinks..

It is now much cheaper and more hospitable to go to Spain than Jersey. Around 25% of the poulation smoke, vote and have disposable income. Any government of a country that cannot provide for the needs of such a large minority is politically inept. Evidence of smoking prevalence in Ireland shows that smoking rose continuously for 14 out of 15 months and after 2 years was only 0.5% below pre-ban levels. Maybe education and considered restrictions are a more acceptable solution.

i think the smoking ban is a good idea and agree that non-smokers shouldn't have to put up with passive smoke. if you look at ireland and other places where this has been brought in it doesn't really affect the smokers and infact most support the ban. it allows them to cut down or quit but doesn't force them to do so. as for the comments about drinking and how people shouldnt have to put up with aggressive behaviour, i think its a little harsh to blame people who drink for rape and violence, those who do commit these offences are going to do it whether they drink or not, but at least if theyre drunk then they can blame the alcohol and not themselves. you have also made out that everyone who drinks is a bad person but i have never once entered a fight or been nasty to anyone when drunk so perhaps you should look further than the very few who spoil it

i agree with everybody that says we should ban smoking in public places. I also think that smoking should be kept away from all children in the area of the smoker.

Personally I would prefer to have seen pubs apply for a smoking licence.

It could start with all pubs being non-smoking by default but giving a pub the opportunity to apply for a smoking licence.

It could be done so only a certain number of pubs in any area is allowed to be smoker friendly.

The licence could be expensive and the money from the licence go to the health service.

Aside from the illiterate posts by the under tens and semi retarded on this message board, most of you don’t realise that smokers not only fund the health service but provide the dutiful deed of dying before they cash their full pensions – thus leaving you whinging non smokers financially better off in later life. In a couple of years time, when the health geeks have their wish of a utopian smoke free island, you will be reaping your own whirlwind of increased taxes and pubs reeking non longer of cigarette smoke, but the smell of your own flatulence caused by too much procrastination of issues which, quite frankly, bore most intelligent people. Smoking is the biggest PREVENTABLE cause of death in the UK.... fact. People are complaining about the loss in tax revenue because of this ban, but the money saved by H&SS over time because of people smoking less will compensate for this. Also, the amount saved by businesses that have to endure workers taking time off due to smoking-related illnesses will be paid in tax, and yet more money will be saved. We also must not forget that a total ban will not cause EVERYONE to give up, and people will still pay taxes on tobacco products becausse they still have the right to continue, but they will just have to do it outside. This ban is not just about the health problems cause by passive smoking. I agree that smoking does affect the comfort of non-smokers in pubs and clubs. Why should a non-smoker have to endure such disomfort as smelling bad, having a sore throat and eyes and generally feeling very uncomfortable because someone else wants to satisfy a habit that affect their's and others' health?

i smoke and i am all in favour of the no smoking law, It would help me quit, alot of my mates in uni dont smoke so i found it easy to quit. but when i came home everyone was smoking and it made me pick it up again.

I was born in Jersey and now live in NZ. We introduced a smoking ban in all public places last year. The hospitality trade initially reported a slump in trade but this soon picked up once everyone got used to the idea. It works brilliantly with most pubs providing an outside area for smokers and of course it means that hospitality staff can save their lungs from second hand smoke! Now it's as if it has never been any different.

I agree with the people saying that clubs/pubs that don't serve food should have the right to allow smoking if they want but these places should have clearly placed signs indicating that they are smoking venues. Also totally banning smoking in workplaces is bit of an unfair idea, I think that workplaces should have designated smoking areas that are as far away as possible from the non smoking areas. I do not want anti-smoking people forcing their agenda on me but I am willing to come to a compromise.

Non-smokers should not have to deal with the by products of those that smoke. If, however, smoking bars are available for those that choose to smoke and the employees agree to work in those establishments... why is legislation necessary..? Hopefully, this will not set a very dangerous precedent for enacting laws to prohibit behaviour which is no longer fashionable. Once you let Government interfere with the private lives of citizens...you have opened "Pandora's Box"....!!

I am very much against smoking and hate it if anyone smokes near to me. I am totally in favour of Senator Syvrets plans.....but let us also look carefully at the problems caused by alcohol, apart from the health issues there are many social problems caused by the abuse of alcohol and abuse (mostly of woman and children) is jsut the beginning. What about all the violence, fighting, public disorder and other acts of crime that are committed after people have drunk too much...

I agree that smoking is bad for you but we have what is called human rights. It is my right to smoke if i want like it is a right for people to get drunk and be sick over my garden! 24 bars? but i will not be able to enjoy them due to this ban. why not adopt the Africans approach and provide seperate rooms / venues for smokers?

I think they should put a ban on smoking in areas were theres being food served. Some people might say you might aswell just ban drinking aswell but thats not true because smoking affects you and others but drinking only affects the person doing it .Many people are put off by places were people are aloud to smoke because they may find it unhealthy and its just as bad to smoke than to be with someone smoking.

I am so fed up with all the bitching about smokers, Almost everyone in the world has the right to live their own lives, to do what they wish, its called HUMAN RIGHTS. So lets have smoking AND non-smoking bars/restaurants. Staff can choose where they want to work (smoking or non), That way EVERYONE HAS A CHOICE. and if your a non-smoker dont go to a smoking establishment, that stops that argument. I dont believe doctors tell us all the facts about smoking as on an America West Flight in Feb 2005 an article in there in-flight magazine was headlined 'What doctors wont tell you about smoking" it tells you that after surgery to have stents put in a blocked artery it is beneficial to smoke for 3 to 6 months as the carbon monoxide keeps the arteries open. so all you medical men give us ALL the Facts. Taxes, it is a valid point most of the money spent on a packet of fags is tax. Also as i am on a Private Health Plan (so therefore pay for any treatment i recieve if i am ill) Can I not claim back all the tax i have paid on fags over the last 28 years ?, At the end of the day everything in life has an effect on your health or well being, be it Smoking, Drinking, Eating, Driving, Sunshine and numerous others. I say LIVE AND LET LIVE and all you moaners find something important to whinge about.

I think it should be a complete ban, if smokers wish to smoke whilst they are out and about then they should go outside (even if it is cold). I do smoke and have done so for far too many years now. Banning smoking in all public places is beneficial to everyones health - that can not be argued. The sooner the complete ban is effective the better.

An increase in taxes is not as valid an argument against the banning of smoking as it may first appear: The potential increase in tax to compensate for the lost duty will be less than the money a smoker would save quitting! The net effect will most likely mean the smoker who has quit will be better off financially!! Not to mention all the extra disposable income you will have to put back into Jersey's economy. The reduction of the financial strain on H&SS caused by smoking related issues will help towards your state pensions – to pay for you living longer. As for businesses – what about all those working days lost through illnesses partly caused by the unhealthy habit - how much does that cost the Island? OK I haven’t the figures to back this up – but nor do you to say we will all be financially crippled if people stop smoking.

Maybe it's because you smoke and already smell that you don't notice it but after coming out of a club/pub from a night out I smell, I cough and I feel horrible for a few days afterwards.

It's not about your right to smoke (you can still do that outside and in your own home) it's about MY right not to breath your smoke.

The whole smoking in pubs and clubs is about a LOT more than health although that is an important side effect.

The most important thing for me is being able to go for a night out and not coming back and have to put all my clothes striahg in the washing because they stink to high heaven of cigarette smoke, find my breathing bad for the next few days 'again' because of the smoke, and find my eyes, hair and whole body smelling so bad I have to shower twice before going to bed just to be confortable.

It's more about comfort for non-smokers than any health issue - a smoker can go outside without effecting anyone else but themselves - a non-smoker has to decide not to go out at all to avoid your smoke.

J.D.A:- M Butler's comments clearly referred to the UK & not "world-wide". Neck & neck in the fight to be the UK's biggest killer is cancer & heart disease. Smoking has a massive impact on the former - no surprise lung cancer is at the top then, & a considerable impact on the latter - as much as diet. The only country that boasts obesity is killing more than smoking is the USA (er... roughly 5% of "world-wide" population)- & even they can't agree on that one. Fact is smoking contributes to the majority of early deaths & I don’t want to become another statistic simply because some else has a filthy habit!

Most of you lot who want to ban smoking are living in cloud cuckoo land. At the moment, the price of a packet of ciggies is almost a fiver. Who do you think takes the bulk of that five pounds ? Its not the nice man in the corner shop. Neither is it the makers of the cigarette. The vast majority goes to the government. They want you to smoke. It is an enormous source of tax revenue from people. It funds the health service. People who smoke don’t live as long as non smokers. Therefore no long term pension costs. If smoking was banned, revenue would have to be raised from other sources – food, clothes, petrol. Lets make things nice and easy. No smoking where food is served. Pubs and clubs can choose to be either smoking or no smoking then let the customer choose where they wish to drink.

Smokers cannot be discriminated against, it purely isnt fair, then why don't we ban drinking?... because that causes more problems than smoking and its perfectly legal. On the other hand, international trends are proving that places where public smoking is banned (ie New zealand, canada, now Ireland too) is improving the reputaion of that country in terms of tourist visitors and social standards.

I smoke and enjoy smoking, and I understand that makes me a truly evil person. But don't worry, I'll be dead soon! If I can't smoke in a pub, then I'll either go outside (if there's a beer garden) or just stay at home. Many people I know think like this as well. Not many smokers are going to just give up at the drop of a hat (or a law). I don't believe this law is going to affect anyone but the owners of the buisnesses, but then I also believe this is a law that is built more on hype and politics than any real care for people's health.

I think a TOTAL BAN is the way to go. I recently went on holoday to Canada and they don't allow smoking in pubs or clubs and it was so much nicer. Your get home and your clothes and hair don't smell of smoke like they do over here.

Thought I would throw in my 2 cents from the other side of the Atlantic.

Many moons ago when the evils of smoking were portrayed by smoking machines puffing away showing what they were doing to our lungs, teeth, future girl friends I wondered when they would stop selling this terrible poison plant.

When the medics got in to it, well, there it was, proof positive that we were killing hundreds of thousands of people.

I truly believed that soon they would ban the sale of the dreadful cigs!!! WHAT??? And lose all that money??? Nah... Let's just restrict them to little areas and as they die off, well, we'll raise the price and maybe even get a few extra bucks out of the whole thing.

So what if we let a few million kill themselves off. Think of the money!!! Then, lo and behold we spread the word of this wonderful money maker along with a final solution to those dirty smokers and their filthy habits to all that would listen, and the countries lined up. But wait...the medics said it was an addiction! you know, like Heroin and cocaine and such. Well, well, better yet, we have created the Golden Goose of all time. And lo the people smiled and cast their eyes in search of other habits.

To all the righteous I say, who among you will stand up for a ban on the sale of tobacco???

I personally believe that smoking should be banned in public places. It is the biggest killer in the UK. It is a filthy habit that most people don’t want to start! A person who smokes thinks that they are “cool”. That is the main reason for many smokers under the age of sixteen. These peoples bodies haven’t fully developed yet, and to smoke would cause a considerable amount of damage to their bodies and its development! From my own research, most said they only smoke to be in the image, to blend in! After they smoke for a while, they will want to experiment other things, try new drugs. This could all be avoided if the ban was brought into action!

I have been advocating for a total smoking ban in public places where food is served for a long time.

One should rid of all ideas, opinions and reports from scientist and non, but consider the fact that smoking in public places where children, non-smokers adults and restaurant staff is rather selfish. This ban eventually will arise to constant arguments, a lot of paper and ink will be wasted as well as problems about how to police it; Eventually all that will be needed will be a little bit of will and common sense from both parties of smokers and non smokers.

A little story of what happened the other night at my restaurant; A lady sitting with her friend who happened to be pregnant, comes to the bar area and asks me if it would be allright to smoke at the bar and politely I replied "yes of course she could" but wanting to stir things up I continued by saying that she could smoke at her table if she wished; the answer? Oh no thanks my friend is pregnant and I don't want to smoke close to her.

In her opinion she felt free to smoke in front of our staff without any problem.

I am very much looking forward to the ban, but whenever it will come into force it will have been many month too late.

Im a Smoker and disagree with a total ban, but if it becomes law then so be it. maybe outside areas of pubs and restaurants should be smokers only ?. but then non-smokers would complain about their right to sit outside. we can't win. but a warning, if i am outside smoking and someone complains (and they do) expect a mouthfull.

A smoking ban in all enclosed public spaces in Jersey would be a great idea. But if this course of action were to be taken, the proper support should be offered to smokers, especially if the ban was not introduced gradually.

Smoking should be banned in lounge areas only in my opinion and the bars should be left to the addicted.This is a fair compromise. Also i feel that barstaff who have to work amongst smokers should be smokers themselves, so the non-addict doesnt't have to endure passive smoking. regards Steven

I have gone to many good restaurants to which I would not return due to smoking, the last on Saturday night. I was washing my hair at midnight and my dry cleaning bill will be almost as much as the meal. The food was brilliant (Italian) but I won't be back until there is a ban . The Restaurant owner said he can't wait.

It's great if they bring the smoking ban in all Restaurants bookmakers and pubs that sell food,im a smoker myself not a heavy smoker just every now and then i would love to see the smoking ban come in ASAP.
