A convicted rapist who was spotted by a CCTV operator as he followed a teenager has walked from court. David McMillan stalked his victim for several minutes in Perth before chasing her as she ran away from him.
At Perth Sheriff Court, a sheriff conceded he could not sentence him for what he might have done. He was instead tagged and set a curfew for 12 months.
The CCTV operator was aware McMillan had served a jail sentence for the rape of a pensioner several years ago.
McMillan, 29, earlier admitted pursuing the 18-year-old woman in Perth late at night on 16 January this year.
The CCTV operators called police who went to the scene and intercepted McMillan as he got to within a few feet of his victim.
Drug counselling order
Sheriff Lindsay Foulis said that, on the evidence, he was not able to conclude McMillan's actions were sexually motivated.
McMillan was instead ordered to be tagged and must remain within his home at Carnegie Place, Perth, between 1900 and 0700 BST every day for 12 months.
He was also placed on probation for three years and was ordered to undergo psychological, as well as drug and alcohol, counselling.
In 1996, McMillan was jailed for life for the rape of an elderly spinster in her own home in Oban.
Lord Milligan said at the High Court in Edinburgh that a life sentence was the only way to ensure he would only be released when he did not pose a danger to the public.
But three judges at the Appeal Court later ruled that the sentence on McMillan was excessive and cut it to nine years, of which he served around half.
