Judges at the Court of Session will rule on the case |
The case of a 90-year-old man denied free personal care funding is to be settled by the Court of Session. Argyll and Bute Council is seeking a judicial review of a watchdog's ruling that it treated the man unfairly.
The pensioner, from Helensburgh, was entitled to free personal care. His local authority withheld funding on the basis that its budget was overspent.
The Scottish Public Services Ombudsman decided that was unfair and called on the council to make backpayments.
The local authority is disputing the report and has asked the Court of Session to rule on the matter.
The local government body Cosla is backing the case.
Councils hope judges will clear up confusion around free personal care provision.
