The Labour peer and MSP, Mike Watson, is due to go on trial in September on charges of wilful fireraising. He is charged in connection with an incident at the Prestonfield Hotel, Edinburgh, last November.
Mr Watson, who represents Glasgow Cathcart at Holyrood, was suspended by the Labour Party after appearing in court on two charges.
The incident followed the Scottish Politician of the Year dinner which was held at the hotel.
In a statement, the Crown Office said an indictment containing charges of wilful fireraising had been served on Mr Watson.
The indictment would first call at Edinburgh Sheriff Court on 23 August with a trial scheduled to begin on 5 September.
