Tagging plan for bailed suspects
Electronic tag
The executive says it supports tagging
Electronic tagging for suspects on bail or waiting to go on trial could be introduced in Scotland.

Tagging can at present be used as a sentence by the courts, particularly in "restriction of liberty orders".

But the existing law is unclear on whether it could be used as a bail condition.

A Scottish Executive spokeswoman said "The law on the use of tagging as a condition of bail could be much clearer.

"The White Paper on High Court reform confirms that the Scottish Executive intends piloting electronic monitoring as a condition of bail."

The White Paper was published earlier this year and the Court Reform Bill, which has the broader aim of speeding up court processes, is expected to be published this autumn.

Tagging could also be examined by the new Sentencing Commission.

The commission has been asked to review bail, as one of its first priorities.

The spokeswoman explained: "Tagging is something that the executive supports."

She added that Justice Minister Cathy Jamieson was "keen" for bail to be the first issue studied by the commission.
