Legal advice is to be sought by MSPs on who is responsible for the education of children being held at the Dungavel immigration centre in Lanarkshire. The move by the Scottish Parliament's petitions committee follows a submission from the Scottish Trades Union Congress (STUC) calling for children to be educated in local schools.
The Scottish Executive has responsibility for education but the Home Office looks after asylum.
The committee has decided to ask the executive's lawyers for a definitive ruling and for an opinion from the Scottish Parliament's own legal department.
The outcome will determine whether or not the STUC petition goes to the parliament's education committee.
MSPs voted last month for an end to the round-the-clock-detention of children at Dungavel.
The STUC, which has campaigned for the closure of the centre, wants Holyrood to take a harder line.
