Roadworks: The motorist's worst nightmare
A gas company in Northern Ireland has been fined for breaking the law while digging up the roads.

It is the first time a public utility has been prosecuted for such an offence.

In the landmark case, Phoenix Natural Gas was fined �750 at Newtownabbey Magistrates Court for failing to comply with traffic safety measures.

The prosecution follows a pledge from the regional development minister Gregory Campbell to get tough on utility companies who break the law during road works.

The move also follows an audit report which criticised the disruption caused by utilities working on the roads.

'Clear message'

Over the last number of years many of Northern Ireland's roads have been dug up again and again by companies installing gas, cable television or doing electricity repairs.

Anecdotal evidence suggests it is a subject which many members of the public feel very strongly about.

A Department of Regional Development spokesman said Wednesday's case sent "a clear message to utilities that the Roads Service will not hesitate to proceed with further prosecutions if warranted".

In 2000 an estimated 46,000 excavations were made on the roads by utilities which have a statutory right to open roads to install, repair or replace their equipment.

However, the Street Works (NI) Order 1995 means companies have to try to keep traffic disruption to a minimum and co-ordinate their repairs where possible.

It is understood the prosecution against Phoenix Natural Gas is only one in a series of cases against companies being pursued by the roads service.
