A council has backed down after imposing a �50 fine on a Teesside woman who put her rubbish out a day early.

Alex Wilkinson from Saltburn, near Redcar, mistakenly put out the wrong colour coded waste bag on the wrong day.

The error landed her with a fixed penalty notice issued by a community warden working for Redcar and Cleveland Borough Council.

Following an outcry by Mrs Wilkinson's friends and neighbours, the council has backed down, conceding she acted "in good faith".

But Mrs Wilkinson, a mother-of-two, says she intends to lodge a formal complaint over the matter.

She said: "I'm glad I've won my appeal and that the council has backed down.

'Sensible outcome'

"But this whole thing has been ridiculous and I am going to lodge a formal complaint.

"It will centre on how I received the fine from the community warden."

The council's cabinet member for environmental improvement, Barbara Harpham said: "Looking at Mrs Wilkinson's appeal, it was clear that she was acting in good faith and rescinding the fine is the most satisfactory and sensible outcome to this case.

"I am issuing a warning to those who think that this decision now gives them the go-ahead to break the law by littering.

"Another important outcome of this case is that we are going to review the last Labour administration's rules and advice to wardens."
