Driver fined for eating ice cream
A pub landlord was booked for not being in control of his car when police spotted him eating an ice cream at the wheel.

Ray Maltby, of The Granby, in Whitby, received a �30 fixed penalty fine after he was stopped on the mile-long journey from the shop to his pub.

The 58-year-old now wants the law clarified for other motorists.

But Insp Tim Hutchinson of Whitby Police said driving while eating posed a risk to pedestrians.

Mr Maltby said he had no idea he was breaking the law and was stumped when the officer pulled him over on Sunday and asked him if he knew what he had done wrong.

"I'd almost got home when I saw a police car with its lights flashing in the rear view mirror," he said.

"I stopped, thinking he was trying to get past, and I was surprised when he pulled up behind me."

Mr Maltby said he thought he was on Candid Camera when the officer handed him a �30 fine.

Insp Hutchinson said Mr Maltby was not wearing a seatbelt, had one hand on the steering wheel and was not thinking about public safety.

"You have someone driving through a busy seaside town with loads of tourists around, driving with one hand," he said.

"Whenever you are driving most responsible drivers think what if something unexpected happens and Mr Maltby put himself in a position where he was driving through streets with many pedestrians and he wasn't in a position to react."
