Coventry Airport denies planning regulations have been breached

The authority recently issued an enforcement notice claiming the airport did not have planning permission.

But in a two-day hearing arguing the issue at the High Court in London last week, Coventry Airport said it had no case to answer.

Mrs Justice Gloster is due to announce her decision on Tuesday.

Budget flights

A council spokesman said if the judge ruled in their favour they would proceed with action against the airport over the terminal.

The council's head of planning and engineering John Archer said: "If the case is dismissed, the council intends to continue with the separate enforcement action against the airport and will defend any appeal against the action at a local public inquiry."

Just one month after the airport started budget flights out of the city, it was told to close the terminal.

The authority said it had consistently and unanimously maintained that the airport's temporary passenger terminal needed planning permission.

The council spokesman said their ultimate aim was to get airport bosses to apply for planning permission for the building so that strict conditions could be placed on it.
