Tesco says the council is breaching its rights
A supermarket chain is taking a Cornwall council to court to get an injunction against the planned demolition of a multi-storey car park.

Tesco wants to stop the demolition of the car park in St Austell in a dispute over its right to access the roof of its town centre store.

The company said it needed access through the car park to use the roof to get to its service plant and equipment.

Restormel Borough Council said it would make sure access provision was made.

The council said the car park at Aylmer Square, which is currently closed, needed to be demolished to make way for a planned �40m redevelopment of the town centre.

The council said it had offered to make sure Tesco has access to the roof and the use of another service road if the car park goes.

Tesco said: "Without these access rights, we can't service the property. In demolishing the car park, the council is breaching those rights."

Tesco is taking the council to the High Court to stop the demolition.
