Tesco says the policy is "morally wrong"
Tesco has revised its insurance policy to allow a couple to claim legal costs while suing the supermarket.

Betty Histon claims she broke her shoulder after falling in a Tesco car park in Bristol.

Her husband has legal cover with Tesco Insurance but was told he could not claim to sue the supermarket as this would be a "conflict of interests".

Tesco Personal Finance now says the policy has been revised because it was "probably morally wrong".

Tesco spokesman Stuart Neill said: "This had never really ever been brought to our attention before so it had been overlooked. It was a unique set of circumstances.

"We contacted the Histons to say if they wish to use the service to take legal action they can do so. They are currently deciding what to do."

He said the exclusion clause on the policy small print, which meant it could not be used to fund claims against Tesco stores, was being taken out.

Mrs Histon said the claim for legal costs was now in the hands of their solicitors.
