An opponent of a windfarm development in Cumbria has said Barrow Council is breaking the law by dropping a planning enforcement action against the scheme.

Opponents of the windfarm above Ireleth were disappointed when the borough council recently decided to drop enforcement action.

That decision is due to be ratified on Tuesday evening, much to the anger of those opposed to the development.

Now leading windfarm opponent David Brierley has written to every councillor claiming that the council's action is illegal.

Noise nuisance

Most of the turbines at Far Old Park Farm, above Ireleth, do not have planning permission.

As well as being built outside the development boundary, the turbines have attracted criticism for noise nuisance and shadow flicker.

Earlier this year Barrow councillors decided to take enforcement action against the development - but this was dropped recently after advice from a barrister.

Instead the council will sign an agreement with the developer imposing a range of planning conditions on the turbines as already built.

Marton, Askam and Ireleth Windfarm Action Group hopes to take legal action against either wind farm owner Power Gen or operator Wind Prospect.
