| Monday, 18 March, 2002, 14:07 GMT Brain-damaged boy's �2.7m award ![]() The High Court in Birmingham made the decision A six-year-old boy has been awarded �2.7m compensation after he was starved of oxygen during his birth at a West Midlands hospital. Morrell Beighton Garner was left with severe brain injuries after he was delivered at Sandwell Hospital on Boxing Day in 1995. The child's mother went into labour on Christmas Day and although medical staff monitored the baby, they failed to realise he was distressed and required an immediate delivery. As a result, Morrell's oxygen supply was restricted leading to damage to the brain. The six-year-old boy is now unable to walk or talk and has to be fed through a tube. 'Devastating effect' The compensation payment was made after hospital managers admitted the error which was made despite doctors constantly monitoring Morrell's heartbeat. The money will be used to buy a house which will be adapted to Morrell's needs, and pay for specialist equipment and therapy.
"This tragedy has had a devastating effect on every aspect of his life." David Lingwood, chief executive at Sandwell Hospital, said: "The trust has accepted responsibility and is very sorry for the mistakes made during the birth. "I hope this settlement will allow Morrell to develop his full potential in the years to come with the help of his loving family." Sara Burns of solicitors Irwin Mitchell, which represents Morrell, said: "This case was not due to a lack of resources, nor scarcity of funding, it was due to signals on the monitor showing the baby was in distress not being acted upon in time. "The hospital admitted responsibility at an early stage in the claim which was a great help to the family.
