If you are divorcing, dissolving a civil partnership or separating you could have to make difficult financial and personal decisions. It might be necessary to sell your home, divide your assets, split a pension or arrange support for children. And you may want to seek guidance to establish what financial rights and responsibilities you and your partner have when splitting up. Using pre-nuptial contracts has recently been given greater weight by The UK Supreme Court which ruled in favour of the agreement made between wealthy heiress Katrin Radmacher and her husband. Where couples make pre-nuptials freely, have a full appreciation of the implications and the outcome does not prejudice the reasonable needs of children and family, The Supreme Court said they should be given decisive weight. But for many couples assets are limited and dividing them can cause hardship. If you want to know more about your rights when separating you can call or e-mail the programme. How do you go about divorcing or ending a civil partnership? Do you have any rights if you have been cohabiting? When can a pre-nuptial or pre-civil partnership agreement help? How can you arrange support for children? Perhaps you need advice about splitting a pension? Where can you find out about family mediation? And what are the legal differences between Scotland and England? Vincent Duggleby was joined by: - Jane Craig, family partner, Manches
- Dani Glover, director of personal financial planning, Smith & Williamson
- Graham Harding, vice chair, Family Law Association of Scotland
