Whistle-blower surgeon reinstated
Walsgrave Hospital
Mr D'Sa was concerned about the quality of operations
A surgeon who raised concerns about the standards of a colleague has been reinstated after being suspended for nearly two years.

Alban Barros D'Sa was suspended in October 1999 after expressing worries about the quality of bowel surgery at Walsgrave Hospital in Coventry.

The High Court and the Court of Appeal had ruled that the 62-year-old surgeon should be reinstated but the University Hospitals Coventry and Warwickshire NHS Trust had refused.

At a meeting on Friday, the trust accepted the findings of an independent panel which looked into the matter and lifted the suspension.

In a statement, it said: "Both the trust and Mr Barros D'Sa are pleased that the matter has been concluded and that he will be returning to work."

Mr D'Sa was suspended after he voiced concerns about the record of a surgeon at Walsgrave, whose mortality rate for operations was four times the national average.

An independent panel set up to investigate the allegations, found him guilty of oppressing a junior doctor but did not consider it a dismissible offence.

The hospital trust refused to reinstate Mr D'Sa and accused him of serious professional misconduct.

Legal challenge

The trust went to the High Court to seek permission to use other evidence in its case against him.

The permission was refused. The trust challenged that decision but last month the Court of Appeal refused to overturn the original ruling.

Despite the judgement the hospital did not allow the surgeon to return to work.

The meeting on Friday had been called to consider the Court of Appeal ruling.
