A photographer jailed after taking topless photos of actress Cameron Diaz and attempting to sell them back for $3.5m (�1.9m) has lost an appeal. John Rutter was jailed in September 2005 for three years and eight months for forgery, attempted grand theft and perjury relating to the photographs.
Rutter unsuccessfully argued that the conviction should be thrown out because of errors at trial.
Charlie's Angels star Diaz was 19 when the pictures were taken in 1992.
The photographer approached her in 2003, when she was an established Hollywood star, and tried to sell the images back to her.
She sued Rutter, claiming she had never signed a model release form for the pictures.
'First refusal'
He launched a counter-suit a few months later, accusing Diaz of fraud and breach of contract.
Rutter denied blackmailing the star and claimed at trial that he had been giving her "right of first refusal" before trying to sell the photographs elsewhere.
He denied forging the release form, but accepted that the signature was probably not real.
Following his conviction, he was ordered to pay undisclosed damages to Diaz.
The actress has appeared in movies including Vanilla Sky, Shrek and There's Something About Mary. Her latest film, The Holiday, co-starring Jude Law, will be released in December.
