Lifestyle trendsetter Martha Stewart could be heading for prison after a judge in the US decided she will not get a retrial. Stewart is due to be sentenced next month for lying about a stock sale.
Her attempt to get a retrial was based on claims that a juror lied to conceal a bias against the celebrity homemaker.
Stewart's lawyers argued the case unfair as a juror failed to disclose that he had been previously arrested for assault.
Judge Cedarbaum said seeking a retrial for juror misconduct was a high hurdle.
The juror in question, Chappell Hartridge, lied repeatedly on his jury questionnaire including failing to disclose that he had stolen money from a Little League baseball group.
Jail
Stewart could now face a jail sentence on 17 June of more than one year.
The TV celebrity was convicted of two counts of making false statements, one of obstructing justice and one of conspiracy.
By selling shares before they dropped in price, the woman famous in the US for style tips, saved herself a few thousand dollars only to be caught out lying about it.
The judge also rejected a motion by Stewart's co-defendant, former stockbroker Peter Bacanovic, for a new trial.
Lawyers for both defendants said they intend to appeal.
Any such appeal would be filed after the sentencing.
